What Type of Claim Can Follow a Texas Construction Accident?

Most private Texas employers can choose whether to provide workers' compensation insurance. Texas law allows an injured employee to pursue damages against a liable third party even when the injury is also covered by workers' compensation. For that reason, a construction injury should not automatically be viewed as only a workers' compensation matter.

Workers' compensation uses different deadlines. An injured employee generally must report a work-related injury to the employer within 30 days and file the appropriate DWC claim within one year to protect workers' compensation rights.
That is why a construction worker should not assume that a single two-year deadline applies to every possible claim.
Early investigation can also matter for practical reasons. Construction sites change, contractors leave projects, equipment is moved, and witnesses may become harder to locate. Identifying the companies involved and preserving relevant records can be important to understanding what happened.
